Have you heard of any hospitals who have agreements between the retail establishments that exist on their hospital campuses that helps each of them avoid carrying the same items?

I would start by searching online for “Sales Exclusivity Agreement Samples.” There are many options that come up, which you could use as a starting point for creating your own agreement.

Your hospital must have a legal advisor either on staff or as a consultant. That person should be designing this document so that it contains appropriate language, is binding and speaks in the same manner as other agreements the hospital has.

Yes, our hospital has always had a “gentleman’s agreement” with our pharmacy. We decided the pharmacy would carry the larger items and we would carry the smaller items, say Tylenol and Advil in single-dose is in our gift shop. Most recently the cafe right across from the pharmacy has decided to carry cough drops, Chapstick, etc. I can see the need for an agreement now too and would love to have a copy if anyone has one.

My guess is that whatever contract you come up with will be of no interest to them. Before you invest energy into producing a contract, will your administrator make them sign it? I would continue to make sure your vendors protect you and if not, stop doing business with them. You might have to work with your pricing structure a bit in order to be more attractive to your customers on the same items that your competitor is selling. Make your shop more of a destination than the other places.
